TERMS AND CONDITIONS OF MOTIVUS-MEMBERSHIPS

⁠1. GENERAL

These terms apply to the agreement (“Membership Agreement”) between the person specified in the agreement (“Customer”) and Motivus. Motivus reserves the right to unilaterally modify this Membership Agreement and its terms for justified reasons.

⁠Updated and current terms and conditions are always available on the Motivus website.

M: All gyms have terms of use. These cover, for example, memberships, payments, and safety. These are the terms of Motivus.

2. MEMBERSHIP

The membership of Motivus is valid from the date indicated in the Membership Agreement.

⁠Motivus' Memberships are contracts of indefinite duration, unless otherwise specified in the Client Agreement or in the Product Information.

⁠If a binding contract period is specified in the Customer Agreement, the contract shall be valid at least for the binding contract period. The summer membership for Ryhmäliikunta 3.0 is a fixed-term membership valid until the end of August. The subscription fee is charged every four weeks. If you pay the subscription fee in August, you can continue to use it until September, until the end of the four-week period.

⁠⁠The Customer Agreement is personal and cannot be transferred to another person, nor can it be used by anyone other than the Customer himself.

⁠The membership entitles the member to use the Motivus Gym specified in the Membership Agreement.

⁠⁠M: Motivus memberships are valid until further notice and can only be used by the person who purchased the membership. Welcome to train with us!

3. PAYMENTS

Customers pay the fee for the chosen product, the joining fee, and any other applicable charges according to Motivus’ pricing.

⁠Discount codes are valid only for the specific products stated in the Motivus price list. If a discount code mistakenly applies to another product during registration, this is a system error that Motivus cannot control. In such cases, we will contact you to collect the remaining amount or cancel the membership.

⁠⁠Membership fees are charged on a recurring basis at the agreed time. If payment is not made by the due date, regardless of the payment method, a payment reminder will be sent with a new due date. In case of delay, Motivus has the right to charge collection fees and interest in accordance with Finnish debt collection laws and other applicable regulations.

M: Motivus doesn’t like sending payment reminders. We find it unpleasant and unkind. The best way to handle payments is definitely via direct debit – it’s easy and effortless. If you run into payment issues, please contact us first!

4. DUTIES AND RESPONSIBILITIES OF THE CUSTOMER

The Customer agrees to familiarize themselves with and follow Motivus safety and conduct rules, and to train safely.

⁠Customers are expected to respect others and behave appropriately. We trust you, and together we can create a training environment everyone enjoys.

⁠Motivus is a substance-free gym, and Customers agree not to use intoxicants, illegal substances, or any substances classified as doping agents.

⁠5. PERSONAL DATA AND DATA PROTECTION

Motivus processes Customer personal data in accordance with our privacy policy and applicable data protection laws.

⁠Our facilities are monitored by video surveillance. The purpose of surveillance is to prevent crimes and misuse, and to ensure the safety of all members. Video surveillance is conducted in compliance with applicable laws.

6. TERMINATION AND CHANGES TO THE AGREEMENT


⁠Membership may be terminated at any time. The notice period is four weeks, meaning the termination takes effect four weeks after the current billing cycle ends.

⁠⁠Membership can be frozen once per calendar year for a single four-week billing cycle. The freeze fee is €5 per 4 weeks. Freezing can be done starting from the next billing cycle or a specific date, but not mid-cycle. A frozen membership cannot be terminated; it must first be reactivated and then terminated according to the terms above.

⁠⁠Memberships can be terminated or frozen via email.

⁠M: Motivus memberships are continuous and can be canceled with four weeks’ notice. Contact us and we’ll handle it for you.

7. DAMAGES, LIABILITIES AND DISPUTE RESOLUTION


⁠At Motivus, Customers train at their own risk. Motivus is not liable for any injuries or accidents that may occur during training. Motivus is also not responsible for theft or loss of the Customer’s personal belongings.

⁠This agreement is governed by Finnish law. Any disputes between the Customer and Motivus will first be resolved through negotiation. If that is not possible, either party may bring the matter before a court of law.
